Your loan agreement, Truth-in-Lending disclosures, and other product documents control the terms of any loan. If those documents conflict with these Terms on a loan-specific issue, the loan documents control for that issue.

Limitation of Liability

Our total liability for claims arising out of website use is limited to the greater of (a) the amount you paid us, if any, solely for website access in the twelve months before the claim, or (b) one hundred U.S. dollars ($100), except where applicable law does not allow such a limit. Nothing in these Terms limits liability that cannot be limited under applicable law.
Indemnity
You agree to defend and indemnify Minto Money and its personnel against claims, losses, and expenses (including reasonable attorneys’ fees) arising from your misuse of the site, your violation of these Terms, or your violation of applicable law—except to the extent caused by our willful misconduct where applicable law so requires.
Governing Law
These Terms are governed by applicable tribal law and applicable federal law, without regard to conflict-of-law rules that would require another jurisdiction’s law. Courts or forums with authority under applicable law may hear disputes about these Terms. Nothing here expands or limits rights that apply under your loan agreement.
Changes to the Site and These Terms
We may update website content and these Terms from time to time. Continued use after changes are posted means you accept the updated Terms, except where applicable law requires a different process. The version posted on this page is the current version for website use.
Mobile Communications / SMS and TCPA Terms
If you provide a mobile number and consent to receive autodialed or prerecorded calls or text messages related to your application or account, you agree that we (and our service providers acting on our behalf) may contact you at that number for informational and account-servicing purposes as permitted by the Telephone Consumer Protection Act (TCPA) and other applicable law.
Message frequency varies. Message and data rates may apply from your carrier. Consent to receive marketing texts, if offered, is not a condition of obtaining a loan. You may withdraw consent for marketing messages by following the instructions in the message (such as replying STOP) or by contacting Customer Care. You may still receive non-marketing calls or messages about your account where allowed by applicable law.
Do not provide a mobile number that is not yours. If your number changes, update us promptly so messages are not sent to someone else.
